What are the legal implications of shipping a development build as a game, if any?

I found a post from 2015 which gave “Short Answer: As long as you don’t use any marketplace content in your game” as a reply which doesn’t seem definitive or entirely accurate.

Where can I find out more about this topic? I’m asking for couple reasons, partly because me and a friend were playing a triple A game recently and he used a mod that was only a few kb to enable the console, and exposed the whole suite of UE editor debug tools in their steam build, and also because my own team went through dev cycles where our dev builds were much more stable than standalone shipping builds.
