TRADEMARK General Question

Hi there,

I just need a “general” clarification on of the trademark agreement conditions. Not asking for legal advice just I need to know if I am interpreting correctly.

If refer to:

Section: 5. Quality Control. It reads:

‘5.4 Submission of Materials for Approval. Licensee shall, at its own expense, prior to any use of
the Marks, and at Epic’s subsequent treasonable request, supply a maximum of three production samples
of the Products to Epic for approval of the use of the Marks in compliance with this Agreement. In the
event that Epic rejects any sample, it shall use reasonable efforts to give written notice of such rejection to
Licensee within 30 days of receipt by Epic of the sample. Licensee shall take all reasonable steps to
immediately cease distribution of such Product using the Marks and shall not recommence distribution
until Epic confirms in writing that it may do so. In the absence of a written notice of rejection, within 30
days of receipt of a sample, the sample shall be deemed to have been approved by Epic’

If I interpret this correctly, does this mean anyone that trademarks with the UE4 logo has to provide x3 production samples of their game to Epic to approve for the use of the UE4 logo in it?

My case situation:

I just want to place the UE4 logo on my website. Does that mean I have to provide copies of my game before doing so?

Just had to add a note that I am not requesting to design the UE4 logo, just using the approved UE4 logo on my site. I think the above could relate to someone if they are designing their own UE4 logo. I look forward to clarification. Thanks everyone

I moved to legal category you should get answer easier that way

Thanks

If you contact the branding@ address on the trademark page and describe what you intend, we should have you covered.

Hi thanks for getting back so fast!

I guess my question is a general question.

Who does: Section: 5. Quality Control. relate to.

Is it more for people who are redesigning or designing a UE4 logo and wishing epic approval?

In my case im not doing that, I am about to sign the trademark agreement license to have the UE4 logo proudly on my website. Im not touching the UE4 logo at all. It’s more of a general question of wondering on some examples of who or what type of people would fit into the Section 5 Quality Control as mentioned up the top if possible.

At a high level, we need to know about how you’re going to use our trademarks. And if we need to see it physically, we have the right to request that. But it relates to the actual use. So if you’re using the mark on the website, there aren’t physical copies of the website to produce. If you’re using the mark on a physical game, there are.

That makes awesome sense. Yeh thanks for that I just wanted to clarify. Awesome! Thank you

At a high level we need to know how you’re going to be using it. We don’t mean literally that it can’t be next to any mark. It mostly means we’re not licensing you any other trademarks (like PARAGON) and of course you can’t use it next to a white supremacy logo.

We’d like to see a mock-up of what you want, but what you describe sounds ok.

Hopefully I can throw in one more “GENERAL” clarification not advice.

This one:

  1. Use of the Marks.

3.2 No Other Marks. Apart from the Marks, no other trademark or logo may be affixed to, or used
in connection with, the Licensed Technology.

(the way i interpret this is obviously not to connect another mark and attach it with the UE4 mark or used together like amending UE4 mark and another mark into one in any manner)

Let’s pretend below is on a pretend website header whilst adhering UE4 whitespace measurements:

Logo A (whitespace) UE4 logo (whitespace) LogoB

Adhering to the UE4 logo whitespace requirements as per the agreement, is it ok to have own logo next to the UE4 logo on the website as long as the whitespace is adhered to for the UE4 logo and that obviously it’s not in anyway being affixed to, or used in connection with like the pretend example above of a website header?

This is the LAST general question I have and I know that only general response could only be provided

Perfect understood thanks again for the very fast response
