Hello, I would like to have some clarification on the promotional content that can be present in a product offered for sale on Fab. In the description of my last clothing pack published on Fab, I added the ADIDAS brand and logo on the character’s t-shirt, and I did the same for the bag with the FROM THE NORTH brand. I then ticked the “Promotional content” box to inform the customer.

Is this correct, or have I misunderstood the meaning of “promotional content”?

If so, I’m going to remove the trademarks and logos. Can I have some information on “promotional content”? I’ve understood its usefulness when it comes to brands that belong to me, but in what cases is it useful when the brand belongs to someone else in the real world?

This is a correct use of ticking the “Promotional content” box for this listing, as you have included the logo of a real-world brand.

However, I would like to point out Section 3a of the Distribution Agreement reads:

You will not provide any Submission Materials or Content to Epic or a Marketplace Operator for which you do not have all necessary intellectual property, publicity, and other proprietary or third-party rights to grant all of the licenses described in this Agreement.

Are you sure that you have the right to use the logos of these brands in your product? Previously, it was forbidden to use real brands on the UE market, since you simply did not have permission from these brands to include them in your product sold commercially.

In general, this whole system with a check mark about advertising content should be explained in a more understandable language in order to understand when to put it.
