Today I was planning on checking out FAB to post content. I got met with the terms of agreement where they BOLD printed a warning to read about the arbitration class action clause at 17 so I went and read it, since they insisted.
”You have the right to opt-out of this class action waiver within 30 days of the date on which you first accepted this Agreement unless a longer period is required by applicable law. To exercise this right, you must send written notice of your decision to the following address: Epic Games, Inc., Legal Department, ATTN: CLASS ACTION OPT-OUT, Box 254, 2474 Walnut Street, Cary, North Carolina, 27518, U.S.A. Your notice must include your name, mailing address, and account name, and state that you wish to opt-out of this class action waiver. To be effective, this notice must be received by Epic and postmarked or deposited within 30 days of the date on which you first accepted this Agreement. You are responsible for ensuring that Epic receives your opt-out notice, so you may wish to send it by a means that provides for a delivery receipt.”
Now what really got me irritated is the fact that they are using “must send a postmarked letter and make sure that it is received” method and creating a hurdle for you to deliberately discourage people ( or lie about receipt ) from acting on this choice of matter, effectively trying to manipulate their legal position. The fact of it alone made me just not want to use the marketplace at all and opt out from the service and instead go to Gumroad or otherwise. Nothing I hate more than displays of slimy corporate tactics and epic lost respect from me as someone I considered a positive in the game development world. Cause that’s just weak.
You may not care, but maybe next time don’t bold text me into reading this ■■■■ at all cause now you deferred my attention from creating products to playing into legal games. Thanks for that, epic.
Here, I am writing a public note that I am opting out of this, as a matter of fact I’ll opt out of the whole agreement.
