Lets say i want to make a boss that is “mario” would i be able to do this and then sell the game without getting sued beyond reality.
Also if i wouldnt be able to do what can i do to have somthing like this in?

You can’t just put Mario in, but you could make a similar looking character with a similar name as a sort of parody
Basically you shall not produce something that might be mistaken by someone’s else brand or you would face a lawsuit.

Don’t bother. You cannot distribute copyright characters in your game, and Nintendo loves cease and desist orders.
