EULA Agreements for ALL formats hosted and sold by FAB

I managed to track down the EULA for Buyers, which is only specifically focused purely on old Epic Marketplace goods. FAB sells my products in many formats, yet I cannot find any links that work to the FAB EULA.

If I include my Studios EULAs with a submission, I am told to remove them as only FAB’s own EULA will prevail, yet none exist except that of Epic. What happens to the protection afforded by a EULA, when there is none for the other formats of our products, such as Unity, FBX, OBJ etc etc?

Are you able to access this page? https://www.fab.com/eula

Yes, and the opening line…

This Fab End User License Agreement ("Agreement ") applies to your use of certain digital assets ("Content ") made available through Epic’s online digital asset marketplace (the "Epic Marketplace "). This Agreement is a legal agreement between you and the Content Licensor. By clicking to indicate your acceptance of this Agreement you are agreeing to be bound by the terms of this Agreement.

Legally, Epic as a company, is not selling my goods, FAB is.

Also, as FAB also sells to other Platform Formats, this EULA does not legally stand with them. FAB is not Epic exclusive.

I have tried several different links to be able to actually read this EULA, most of which are broken. It does not inspire confidence when a website is broken like that. Nor, when in one document FAB is cited, then Epic in another. Epic will not pursue any of my packs that are sold to Unity users, should they infringe any laws take place, as you do not have jurisdiction. No more than it will pursue anyone buying a Mesh/Texture combination for other platforms. That will be solely left up to each seller, that are not allowed to include our own Terms and Conditions/EULAs, that we could include using the Project Settings of the Editors.

FAB, in comparison to what was available on Epics Marketplace, pales in comparison, leaving many Sellers feeling this was cobbled together in a hurry and it is what it is. Not an update or upgrade but almost an abandonment. This stems from the massive release of 100% free Megascans, that is supported by nanite to overcome the massive overheads. Who, can compete with such assets and do so for free?
