Does a Custom License Version of Unreal trigger Royalty Payments when using Marketplace Plugins?

Hello! I am working with our publisher’s legal department to better understand the Marketplace plugins and how it affects our custom license. Under the Epic Content License Agreement, there is a section called Marketplace Content Addendum that describes royalty payments for “Plugins”. In this section, there is mention of royalty payments, but that seems to refer back to the original EULA.

I’m hoping you can clarify a few points for us:

  • Using our publisher’s flat-fee custom licensed version of Unreal, can we purchase and use Marketplace assets without triggering the royalty payments?

  • Is there a distinction between code plugins and content plugins with respect to how they trigger the royalty payments? And if so, is there a clear way to identify them in the Marketplace.
