Datasmith 3DsMax Actor vs StaticMesh

When im importing meshes from my 3Dsmax scene, some come into Unreal as StaticMeshes (as i would have expected and desired) some however come in as an ‘Actor’ with a child static mesh actor inside it.. Which makes my scene very inconsistent and i cant figure out why this is happen.

Both are Editable Meshes in Max, with no parent or children assigned, ive also reset my pivots on both and still happens. Anyone have a solution or suggestion to fix?
