Maybe move the post to marketplace category or tag it with “legal”, this is more of a legal question. If I understand the question correctly, you basically wish to provide funding for another party to develop their game with your idea and when is done you wish to “use” it in a retail store. Use as in let people play it on a public console in the store? Or do I not understand the question? It would completely be up to a contract you agree on with them.
If you own everything about it and simply hired someone to perform some tasks for you then I don’t see why not. Again just check the contracts you set up with that person so they won’t claim otherwise.
